Procedure – supporting documents required for transferring a Greek trademark
To transfer a Greek trademark, the following supporting documents should be submitted to the Department for Trademarks of the Ministry of Economy, Infrastructure, Maritime Affairs and Tourism:
(1) Private (or notarial) agreement signed by the contracting parties. Where the contracting parties are legal persons, the agreement should be signed by their legal representatives or other persons duly authorised to this effect. The signatures in a private agreement should be authenticated by a Citizens’ Service Centre (KEP) or a public authority.
(2) Where the contracting parties are legal persons, the following should also be submitted:(a) for sociétés anonyme and limited liability companies, the Government Gazette issue establishing the company’s representation,(b) for general partnerships or limited partnerships, the Articles of Association certified by the Court of First Instance or the relevant Chamber of Commerce.Foreign companies shall submit the corresponding supporting documents.
(3) Application including the full name, signature and seal of the authorised attorney-at-law.
(4) Simple proxy for the purchaser company’s legal representative appointing a proxy and agent for the particular transfer, including the signature of the legal representative and the company seal. Where the transferor is a natural person, the proxy shall only include the transferor’s signature.The above proxy may be replaced by the relevant provision in the private (or notarial) agreement entered into between the contracting parties regarding the appointment of an attorney-at-law for the particular transfer.
(5) State fee amounting to EUR 90.
Transfer of a Community trademark is carried out online through the Office for Harmonisation in the Internal Market (OHIM) website (https://oami.europa.eu/ohimportal/en/home) by filling in and submitting at no charge (from 25.07.2005) the corresponding e-form available on said website.
Lastly, transfer of an international trademark requires filling in the relevant paper application, available on the website of the World Intellectual Property Organisation (WIPO) (http://www.wipo.int/portal/en/index.html), and submitting it to the Department for Trademarks, which shall transfer the relevant request to the corresponding service of the WIPO. The fee for transferring an international trademark amounts to CHF 177 (approximately EUR 170) per registered trademark transferred.
