Requirements for the exercise of the profession of Real Estate Agent (Greek Law 4072/2012 – Article 198)

In order to exercise the profession of real estate agent, the following conditions must be met by the person concerned or, in the case of a legal entity, by at least one of the persons representing it, and more specifically:
a) He/She must be a Greek citizen or a citizen of a Member State of the European Union or a Member State of the European Economic Area (EEA). The citizen of a third country is required to have a residence and work permit in Greece, or a residence permit for independent economic activity.
b) He/She must not have been convicted of a felony or misdemeanor for the offences of theft, embezzlement, fraud, misappropriation of funds, forgery or misuse of stamps, dishonesty, perjury, fraudulent bankruptcy, defrauding creditors, loan sharking, issuing a bad cheque or any of the currency offences.
c) He/She must not have been subjected to total or partial judiciary support.
d) He/She must hold a national high school diploma or an equivalent certificate from a school of a foreign country.
2.The fulfilment of the conditions of paragraph 1 is proved by the following documents:
a) Identity card or passport, in case of a Greek citizen or a citizen of a member state of the European Union or a member state of the European Union, or, in case of a citizen from a third country, a residence and work permit issued in Greece, or a residence permit for independent economic activity.
b) A declaration that he/she has not been convicted of the offences referred to in point b of paragraph 1.
c) A certificate stating that he/she has not been subject to legal representation.
d) A national high school diploma or equivalent certificate from a school of a foreign country.
3. In the case of a real estate agent recognized and established in a member state of the EU or a member state of the EEA, who wishes to establish a branch, office or other establishment in Greece, a certificate of registration in a register or other competent authority or professional organization is required, in accordance with the legislation of the country of establishment. Such a real estate agent shall bear the title attributed to him in the country of his principal establishment.
4. The above-mentioned documents and certificates shall be submitted by the interested party to the competent chamber, which, after checking their validity, shall register the interested party in the records of the chamber and in the General Commercial Register (G.E.MI.), subject to the provisions of paragraph 7.
5. The above-mentioned requirements must be fulfilled on a permanent basis and checked by the competent chamber. To this end, real estate agents shall be obliged to inform the competent chamber within one month of the discontinuation of the conditions required for registration in accordance with paragraph 1. If any of these conditions cease to apply, the real estate agent shall be deleted from the General Commercial Register (G.E.MI.) and the records of the Chamber.
6.The exercise of the profession of real estate agent and registration in the G.E.M.I. is prohibited to those real estate agents to whom the disciplinary penalty of permanent deprivation of the right to exercise the profession or temporary deprivation have been imposed, for as long as it is in force, or the ancillary penalty of prohibition to exercise the profession of real estate agent, for as long as it is in force.
7.Real estate agents recognized by a Member State of the EU or a Member State of the European Union and established therein, who perform occasionally brokerage operations in Greece in the context of the cross-border provision of services, as defined in Article 197 (the suggestion of opportunities or mediation for the conclusion of contracts relating to real estate and in particular contracts of sale, exchange, rent, leasing, establishment of servitude or valuable consideration of real estate) are not required to be registered in the G.E.M.I, provided that they fulfil the requirements of the home Member State for carrying out real estate brokerage operations.
